eBookBay Terms of Service

Term Definitions:

  • eBook: An e-book (short for electronic book, or eBook), also known as a digital book, is an e-text that forms the digital media equivalent of a conventional printed book.

  • eGuide: An e-guide is a (usually) short instructional digital version of a guide.

  • Items: eBooks and eGuides are referred to as “Items” in this context.

GENERAL


  • You must be 13 years or older to use eBookBay.com. If you are under 13, you may use the site with parental supervision.

  • You must be human. eBookBay.com does not permit accounts registered by automated methods.

  • You may not use eBookBay.com for any illegal or unauthorized purposes.

  • You may not use eBookBay.com to abuse, bully, harass, threaten, malign, slander, impersonate or intimidate anyone. If you become aware that a user is engaging in prohibited activity, please email us at support@ebookbay.com.

  • You may not post potentially personally-identifying and personally-identifying information about any individual eBookBay.com user without their consent.

  • If eBookBay.com terminates your account for any reason, you may not create another eBookBay.com account without eBookBay.com’s written permission to do so.

  • The only items to be sold on eBookBay.com are eBooks and eGuides.

  • Only registered users can buy and sell on eBookBay.com. Registration is free.

  • You may not offer or accept payments using any method other than placing an order through eBookBay.com. Items must be ordered using the ‘Buy Now’ button.

  • Items on eBookBay.com must be priced with a minimum price of $1.00 USD.

  • We reserve the right to remove listings by discretion and for whatever reason.

  • Violation of eBookBay.com’s Terms of Service may get your account permanently disabled.

  • This website has no control over the quality, safety or legality of the items listed or the truth of accuracy of the listings.

  • This website shall not be responsible for any items sold nor for misrepresentations and/or breaches of contract by either buyer and/or seller.

  • This website is not responsible for any of the listings that users post and assumes no liability for the content of the listings.

  • If you are the rightful owner of any material posted on this website, and object to them being displayed, please contact our support team and it will be removed immediately. This website cannot be held responsible for this material without being contacted and having been given the chance to remove it.

SELLERS


  • When an item is sold, the seller will receive the money (after eBookBay commission fees) credited to his or her account. This is displayed in the "My Sales" component in the "My Account" page.

  • Funds may be redeemed once the seller has $10 USD or more in their 'My Sales' balance.

  • Funds must be redeemed through PayPal only.

  • Seller acknowledges that the buyer's payment will be sent automatically (via PayPal) to eBookBay.com.

  • Items will be delivered via eBookBay.com’s automated eBook delivery system.

  • Seller's eBook listing rating and reviews are based on ratings received from buyers.

  • To protect our users' privacy, user identities should be kept anonymous. Requesting or providing email addresses, Skype/IM usernames or any other personal contact details (other than your name) is not permitted.

  • Sellers must have all the proper rights to sell the item they want to sell. Listing for sale a copyright protected item will result in immediate account termination.

  • eBookBay reserves the right to decline any withdrawal requests made if the seller is involved in suspicious activity or illegitimate transactions.

  • Sellers have the option to upgrade their listings via use of eBookBay Credits.

  • Listing or sending adult, illegal, rude, abusive, improper, copyright protected, promotional, spam, violent or any nonsense is strictly prohibited. Doing so will get your account terminated permanently.

BUYERS


  • Items must be purchased using PayPal and the order must be placed through eBookBay.com.

  • Once payment is confirmed, the buyer will be able to download the item instantly.

  • You may not offer or pay using any method of payment other than eBookBay.com’s.

  • As a buyer, your identity is kept anonymous at all times. To protect your privacy, avoid requesting or providing email addresses, Skype/IM usernames or any other personal contact information.

  • You may not pay other users directly using their PayPal account. In case you have been asked to use an alternative payment method, please report it immediately emailing us at support@ebookbay.com.

  • Avoid filing a dispute or reversing a payment through PayPal or your bank. Doing so may get your account blocked.

  • In case of a problem, always try and work things out with your seller. If you need further assistance, contact our customer support by emailing us at support@ebookbay.com.

  • Buyers may not resell purchased eBooks, unless otherwise stated.

  • If the buyer is unsatisfied with the eBook, a refund is not offered. Buyers purchase eBooks at their own risk.

  • In the case of an illegitimate or suspicious transaction, a refund will be issued to the buyer and the seller's listing will be removed.

PayPal Acceptable Use Policy


You are independently responsible for complying with all applicable laws in all of your actions related to your use of PayPal's services, regardless of the purpose of the use. In addition, you must adhere to the terms of this Acceptable Use Policy.

    Prohibited Activities

    You may not use the PayPal service for activities that:

  1. violate any law, statute, ordinance or regulation

  2. relate to sales of (a) narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety, (b) drug paraphernalia, (c) items that encourage, promote, facilitate or instruct others to engage in illegal activity, (d) items that promote hate, violence, racial intolerance, or the financial exploitation of a crime, (e) items that are considered obscene, (f) items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction, (g) certain sexually oriented materials or services, or (h) ammunition, firearms, or certain firearm parts or accessories, or (i) ,certain weapons or knives regulated under applicable law

  3. relate to transactions that (a) show the personal information of third parties in violation of applicable law, (b) support pyramid or ponzi schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs, (c) are associated with purchases of real property, annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card, (d) are for the sale of certain items before the seller has control or possession of the item, (e) are by payment processors to collect payments on behalf of merchants, (f), are associated with the following Money Service Business activities: the sale of traveler’s checks or money orders, currency exchanges or check cashing,or (g) provide certain credit repair or debt settlement services

  4. involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent

  5. violate applicable laws or industry regulations regarding the sale of (a) tobacco products, or (b) prescription drugs and devices

  6. involve gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not it is legally defined as a lottery) and sweepstakes unless the operator has obtained prior approval from PayPal and the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.

TERMS OF SERVICE CHANGES


  • Although most changes are likely to be minor, eBookBay.com may change these Terms of Service from time to time, and at eBookBay.com’s sole discretion. eBookBay.com encourages visitors to frequently check this page for any changes to its Terms of Service. Your continued use of this site after any change in these Terms of Service will constitute your acceptance of such change.
